This Privacy Policy and Personal Data Protection Policy applies to all users of the website www.pivkadelamaris.eu (hereinafter: the website), which is managed by Pivka d.d., Kal 1, 6257 Pivka (hereinafter: Pivka or the Pivka – Delamaris Group).

The controller of personal data submitted by individuals is Pivka d.d., Kal 1, 6257 Pivka.
Collection and Use of Personal Data
The Pivka – Delamaris Group respects and protects the privacy of website users, and processes personal data responsibly and in accordance with the Personal Data Protection Act (ZVOP-1) and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).
The controller processes user data to fulfil its obligations for the purposes of identifying individuals in the event of handling complaints and other purchase-related communications.
The controller collects and processes personal data of individuals upon registration and the individual’s consent to receive e-newsletters or recipes, and in connection with prize draws. By participating in any of these activities, the following personal data will be processed: first and last name, email address, residential address details, country of residence, phone number, IP address, registration data, and communication history. The Pivka – Delamaris Group requires this data for communication purposes, as well as for preparing and delivering responses and benefits tailored to the user’s interests.
Based on an individual’s consent, the controller may process personal data for the purposes of preparing and sending personalised offers and informing users about offers of interest to them. Notifications are sent via selected communication channels. The provision of personal data is voluntary and may be withdrawn at any time. Data is retained until the individual’s consent is revoked or a deletion request is received.
The controller may process certain personal data (first and last name, address, email address, phone number) for direct marketing purposes and to assess customer satisfaction with services or the user experience, based on legitimate interest, provided the individual does not object to such processing.
Data for which the Pivka – Delamaris Group does not require the individual’s consent is processed in accordance with applicable legislation.
Purpose of Collecting Personal Data
The Pivka – Delamaris Group collects personal data on the website for the following purposes:
- improving the quality of content and functionality of services on the website;
- creating personalised offers and informing users about offers of interest to them, only via selected channels;
- market research, with the aim of optimising the offering and costs and increasing customer satisfaction;
- sending e-newsletters and other promotional materials;
- handling complaints;
- communication and delivery of prizes in prize draws.
Storage of Personal Data
The Pivka – Delamaris Group appropriately stores and protects personal data in electronic form at the company’s registered address. Data processed for the purpose of fulfilling contractual obligations is retained until all obligations arising from the contractual relationship have been fulfilled, or for a maximum of 5 years after fulfilment of all obligations, upon expiry of the limitation periods relating to individual claims.
Data processed on the basis of an individual’s consent is retained by the controller until that consent is revoked. Users may submit a written request to withdraw consent for the use of personal data at any time by writing to marketing@pivkap.si.

The Pivka – Delamaris Group ensures privacy protection by complying with all applicable legal regulations. Pivka also provides all necessary technological and organisational support to protect personal data against loss, alteration, theft, and access by unauthorised third parties.

- to an external contracted agency that manages the website on behalf of the Pivka – Delamaris Group. The agency acts exclusively in the name of, on behalf of, on the instructions of, and under the supervision of Pivka Perutninarstvo, for the purpose of providing technical, content-related, and user experience services on the website;
- to an external web application used for sending e-newsletters, which operates exclusively in the name of, on behalf of, on the instructions of, and under the supervision of Pivka Perutninarstvo;
- if data is requested by state authorities that provide a written explanation requesting data for the purposes of conducting a specific proceeding.
User Rights
Individuals have the following rights in relation to the processing of their personal data:
- the right of access to data,
- the right to rectification,
- the right to erasure (“the right to be forgotten”),
- the right to restriction of processing,
- the right to data portability, and
- the right to object.
An individual to whom personal data relates may request the exercise of these rights by submitting a request to marketing@pivkap.si. Pivka will grant the request or notify the individual of the reasons for refusal without undue delay, and at the latest within 15 days of receiving the request.
Right of Access to Data
An individual to whom personal data relates has the right to obtain from the controller confirmation as to whether personal data concerning them is being processed, and where this is the case, access to the personal data and the following information:
- the purposes of processing;
- the categories of personal data;
- the recipients or categories of recipients to whom personal data has been or will be disclosed, in particular recipients in third countries or international organisations;
- where possible, the envisaged period for which personal data will be stored, or if not possible, the criteria used to determine that period;
- the existence of the right to request rectification or erasure of personal data or restriction of processing of personal data concerning the individual, or the right to object to such processing;
- the right to lodge a complaint with a supervisory authority;
- where personal data is not collected from the individual, any available information as to its source;
- the existence of automated decision-making, including profiling, and meaningful information about the logic involved, as well as the significance and envisaged consequences of such processing for the individual.
Pivka provides the individual with a copy of the personal data being processed. Where the individual submits the request by electronic means and unless otherwise requested, the information is provided in electronic form.
Right to Rectification
An individual to whom personal data relates has the right to obtain from Pivka the rectification of inaccurate personal data concerning them. Taking into account the purposes of processing, the individual also has the right to have incomplete personal data completed, including by providing a supplementary statement.
Right to Erasure (“Right to Be Forgotten”)
An individual to whom personal data relates has the right to obtain from Pivka the erasure of personal data concerning them. Pivka must erase the data where:
- the personal data is no longer necessary for the purposes for which it was collected or otherwise processed;
- the individual withdraws the consent on which the processing is based, and there is no other legal basis for the processing;
- the individual objects to processing based on the controller’s legitimate interest and there are no overriding legitimate grounds for the processing, or the individual objects to the processing;
- the individual objects to processing for direct marketing purposes;
- the personal data has been processed unlawfully;
- the personal data must be erased to comply with a legal obligation under EU law or Slovenian law.
Right to Restriction of Processing
An individual to whom personal data relates has the right to obtain from Pivka the restriction of processing where:
- the individual contests the accuracy of the data (for a period enabling the controller to verify the accuracy of the data);
- the processing is unlawful and the individual opposes erasure and requests restriction of use instead;
- the controller no longer needs the data for processing purposes, but the individual requires it for the establishment, exercise, or defence of legal claims;
- the individual has lodged an objection to processing, pending verification of whether the controller’s legitimate grounds override those of the individual.
Where processing has been restricted, such personal data may, with the exception of storage, only be processed with the individual’s consent, or for the establishment, exercise, or defence of legal claims, or for the protection of the rights of another natural or legal person, or for reasons of important public interest of the EU or Slovenia.
Right to Data Portability
An individual to whom personal data relates has the right to receive personal data concerning them, which they have provided to the controller, in a structured, commonly used, and machine-readable format, and the right to transmit that data to another controller (where technically feasible) where:
- the processing is based on the individual’s consent or a contract, and
- the processing is carried out by automated means.
Right to Object
An individual to whom personal data relates has the right to object at any time to the processing of their personal data where processing is based on the legitimate interests of the controller. Pivka will cease processing the personal data unless it demonstrates compelling legitimate grounds for the processing which override the interests, rights, and freedoms of the individual, or for the establishment, exercise, or defence of legal claims.
The individual has the right to object at any time to the processing of their personal data for direct marketing purposes and to profiling insofar as it is related to such direct marketing. In that case, the personal data will no longer be processed for those purposes.
Right to Lodge a Complaint Regarding the Processing of Personal Data
Any complaints regarding the processing of personal data may be submitted to marketing@pivkadelamaris.si.
Where an individual believes that their rights in connection with the processing of personal data have been violated, they also have the right to an effective remedy and to lodge a complaint with the Information Commissioner.
Persons Under the Age of 15
Persons under the age of 15 may only submit their data via the website with the explicit permission of their parents, foster parents, or guardians.
Final Provisions
The Pivka – Delamaris Group reserves the right to amend and supplement these General Terms and Conditions. Users of the website will be notified of any changes to these General Terms and Conditions via the website.
